Married & De Facto Property Settlement

Jones Leach Lawyers has represented many clients during this often-turbulent time, whether their asset base was extensive and complicated or more modest.

Where in that spectrum a client may fall does not affect the level of service they are offered by our team. In all cases we strive to understand your personal situation and offer solutions that assist you to achieve the best outcome, balancing the factors of time, personal cost and commerciality.

How can we help?

Jones Leach Lawyers can be involved in your resolution in the following ways:

If you have reached agreement, we can assist by:

  • Documenting the agreement so that it is final and binding either by way of:
    •  Consent Orders;  or
    •  Binding Financial Agreement
  • Ensuring that by the documentation you become legally entitled to the benefits of the agreement as you understand them to be
  • Advising you of your rights and whether the proposed agreement is reasonable and reflective of those rights
  • Advising and assisting in the implementation of the orders or of the agreement.

If you have not reached agreement, we can assist by:

  • Advising you about your rights
  • Negotiating settlement with the other party if possible:
    • By correspondence; or
    • If necessary, at a round-table conference.

If settlement is achieved, we can assist by:

  • Documenting the agreement so that it is final and binding either by way of:
    •  Consent Orders;  or
    •  Binding Financial Agreement
  • Ensuring that by the documentation you become legally entitled to the benefits of the agreement as you understand them to be
  • Advising and assisting in the implementation of the orders or of the agreement.

If settlement is not achieved, we can assist by:

  • Advising you about the steps available to move the matter forward and the likely costs
  • If instructed, issuing Court proceedings and conducting the proceeding on your behalf through mediation and a hearing, if necessary, although in our experience, it is commonplace for matters to settle before the hearing date is reached
  • Advising and assisting in the implementation of the agreement.

Both generally and in the particular context of property settlement, we are skilled in dealing with the complexities of:

  • Family trusts
  • Companies
  • Partnerships and other business relationships
  • Superannuation including self-managed funds.

During this vulnerable period, moving forward can seem an uncertain task. Give our team a call or book a consultation online, and they'll guide you through the maze.
